Selling Costs in Nebraska: What to Know
When you sell land in Nebraska, the main state charge is the documentary stamp tax. The seller pays it when the deed is recorded. The rate went up on July 18, 2026, so older guides show the wrong number.
Other costs include recording, title work, your share of property taxes and income tax on any gain. Below is each cost, who usually pays, and a worked example for a $25,000 lot.
Nebraska documentary stamp tax
Nebraska taxes the grantor, the person who signs the deed, for each transfer of real estate (Neb. Rev. Stat. 76-901). The county register of deeds collects it when the deed is recorded (Department of Revenue).
The rate has changed twice in a short time. It was $2.25 per $1,000 until September 2, 2025, then $2.32, and since July 18, 2026 it is $3.32 per $1,000 of value or fraction. A 2026 law sets it back to $2.32 on January 1, 2032 (rate history).
For a sale, value means the full price paid, including any liens the buyer takes over. Some transfers are exempt, such as certain family and estate transfers; see the list in 76-902.
Who pays what by custom
The statute puts the stamp tax on the seller. Other costs are set by the contract. Buyers often pay to record their deed, and the title company's closing fee is often split. Title insurance follows local practice, so ask the title company.
Property taxes are usually prorated to the closing date. Each sale also needs a Real Estate Transfer Statement, Form 521, which goes to the register of deeds with the deed.
Recording fees
State law sets the register of deeds fee at $10 for the first page and $6 for each added page (33-109). A two page deed costs $16 to record.
Attorney or title company closing

Capital gains basics: federal and state
Your taxable gain is the sale price minus your selling costs and your basis. Basis is usually what you paid plus improvements such as surveys, roads or wells. For inherited land, basis is generally the value on the date of death; see IRS Publication 551.
If you owned the land for more than one year, the federal government taxes the gain at the long-term rates of 0%, 15% or 20%, based on your income. Land held one year or less is taxed at your ordinary income rate. See IRS Topic 409. Higher earners can also owe the 3.8% net investment income tax (IRS Topic 559).
The home sale exclusion covers your main home. A separate vacant lot does not usually qualify on its own; see IRS Topic 701. The closing agent normally reports the sale to the IRS on Form 1099-S.
